These Terms and Conditions ("Terms," "Terms and Conditions") govern your access to and use of the Talehunter website, products, digital memory pages, QR codes, and related services (collectively, the "Services").

Talehunter ("Talehunter," "we," "us," or "our") operates talehunter.co.

By accessing our website, purchasing a Talehunter product, creating an account, uploading content, or using a Talehunter QR code or digital memory page, you agree to these Terms and Conditions and our Privacy Policy.

If you do not agree with these Terms, please do not use our Services.

1. Eligibility

You must be at least 18 years old to purchase products or create an account with Talehunter, unless otherwise permitted by applicable law and with appropriate parental or guardian involvement.

By using Talehunter, you represent that you have the legal capacity to enter into these Terms.

If you are purchasing a Talehunter product as a gift for another person, you are responsible for providing accurate information and ensuring that your use of the Services complies with these Terms.

2. Talehunter Services

Talehunter provides physical products and digital services designed to help customers preserve hunting, fishing, outdoor, and other personal memories.

Our Services may include:

Custom engraved plaques and other physical products
QR-code products
Digital memory pages
Photo, video, and audio storage
Written memory or story storage
User accounts and profiles
Custom product personalization
Other products and services offered through Talehunter

The specific features available to you may vary depending on the product or service purchased.

Talehunter may modify, add, or discontinue features of the Services from time to time.

3. Accounts

Certain Talehunter features may require you to create an account.

You agree to provide accurate and current information when creating an account and to keep that information updated.

You are responsible for:

Maintaining the confidentiality of your login credentials
All activity occurring through your account
Ensuring that your account information remains accurate
Not sharing your password or account credentials with unauthorized individuals

If you believe your account has been accessed without authorization, you should contact Talehunter promptly.

Talehunter reserves the right to suspend or terminate accounts that violate these Terms or otherwise create a security, legal, or operational risk.

4. Orders and Purchases

When you place an order through Talehunter, you agree to provide accurate billing, shipping, contact, and personalization information.

Submitting an order constitutes an offer to purchase the selected products.

Talehunter reserves the right to:

Accept or decline an order
Correct pricing or product-description errors
Cancel an order when necessary
Limit quantities
Refuse service where permitted by law

An order is not considered accepted until Talehunter confirms the order.

If we are unable to fulfill an order after payment has been received, we will provide an appropriate refund or other resolution.

5. Product Pricing

We make reasonable efforts to ensure that product descriptions, photographs, prices, and availability are accurate. However, occasional errors may occur.

Talehunter reserves the right to correct errors and, where appropriate, cancel an order affected by an incorrect price or product description.

Applicable sales tax, shipping charges, and other fees may be added to the purchase price where required.

6. Custom and Personalized Products

Many Talehunter products may be customized or personalized.

You are responsible for reviewing the information you provide for customization before submitting an order.

Names
Dates
Locations
Text
Engraving instructions
Images
Other personalization information

Because personalized products are created specifically for you, they may not be eligible for return or refund solely because you entered incorrect personalization information.

Talehunter is not responsible for errors resulting from incorrect information submitted by the customer.

If Talehunter makes an error in producing your personalized product that differs from the information you submitted, please contact us so that we can determine an appropriate resolution.

7. Shipping and Delivery

Talehunter will provide estimated shipping or processing times when available.

Estimated delivery dates are not guaranteed unless expressly stated otherwise.

Talehunter is not responsible for delays caused by circumstances outside our reasonable control, including:

Shipping carrier delays
Weather
Natural disasters
Government actions
Labor disruptions
Incorrect addresses
Lost or stolen packages after confirmed delivery
Other events beyond our reasonable control

You are responsible for providing an accurate shipping address.

8. Returns and Refunds

Talehunter's return and refund policies may vary depending on the type of product purchased.

Because custom and personalized products are made specifically for individual customers, they may be subject to different return restrictions than standard products.

If you receive a damaged, defective, or incorrect product, contact Talehunter as soon as reasonably possible after delivery.

We may request photographs or other information to help determine the appropriate resolution.

Nothing in this section limits any rights you may have under applicable consumer-protection laws.

9. Digital Memory Pages

Talehunter may provide digital memory pages associated with physical QR-code products.

A QR code may direct users to a particular Talehunter page containing content uploaded or provided by the customer.

Depending on the features available, a memory page may contain:

Photos
Videos
Audio recordings
Written stories
Names
Dates
Descriptions
Other user-provided content

The customer is responsible for the content placed on their memory page and for determining who should have access to that content.

If you share a QR code or digital memory page with another person, that person may be able to access the content associated with the QR code.

You should not upload information that you do not have the right to share.

10. QR Codes

Talehunter QR codes are designed to provide access to digital content associated with a customer's account or memory page.

QR codes may be printed, engraved, displayed, or incorporated into physical products.

Talehunter does not guarantee that a QR code will remain readable indefinitely under every physical condition. Damage, wear, environmental exposure, alteration, or deterioration of the physical product may affect the ability of a device to scan the QR code.

Talehunter is also not responsible for compatibility issues caused by third-party devices, operating systems, browsers, internet connections, or scanning applications.

11. User Content

You may upload or submit photos, videos, audio recordings, stories, text, and other material to Talehunter ("User Content").

You retain ownership of your User Content.

By submitting User Content to Talehunter, you grant Talehunter a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and process your User Content as reasonably necessary to provide and operate the Services.

This license exists solely for purposes such as:

Storing your content
Displaying your memory page
Making your content accessible through your QR code
Providing backups
Maintaining the Services
Troubleshooting technical issues
Protecting the security and integrity of the Services

Talehunter does not acquire ownership of your memories, photographs, videos, audio recordings, or stories merely because you upload them.

12. Your Responsibility for User Content

You represent and warrant that you have all rights, permissions, and authorizations necessary to upload and use your User Content through Talehunter.

You may not upload or submit content that:

Infringes another person's copyright, trademark, privacy, publicity, or other rights
You do not have permission to use
Contains unlawful material
Contains malicious software
Is intended to harass, threaten, or harm another person
Is fraudulent or misleading
Violates applicable laws
Violates these Terms

You are responsible for obtaining permission from other individuals appearing in photographs, videos, recordings, or other content when such permission is legally required.

13. Content Removal

Talehunter reserves the right to remove, restrict, disable access to, or investigate User Content that we reasonably believe:

Violates these Terms
Violates applicable law
Infringes another person's rights
Creates a security risk
Is fraudulent, abusive, or harmful
Could expose Talehunter to legal liability

We may also cooperate with lawful requests from courts, government agencies, or law enforcement.

We are not required to monitor all User Content and do not assume responsibility for doing so.

14. Prohibited Uses

You may not use Talehunter to:

Violate any applicable law or regulation
Infringe intellectual-property rights
Attempt to gain unauthorized access to another account or memory page
Circumvent security measures
Upload malicious code or software
Interfere with the operation of the website or Services
Attempt to access information belonging to another customer without authorization
Use the Services to harass, threaten, defame, or harm others
Impersonate another person or organization
Use automated systems to improperly access or scrape the Services
Resell or exploit the Services without authorization
Use the Services for fraudulent purposes

Talehunter may suspend or terminate access for violations of these restrictions.

15. Intellectual Property

The Talehunter website, including its branding, logos, designs, graphics, text, software, product designs, and other materials provided by Talehunter, is owned by or licensed to Talehunter and is protected by applicable intellectual-property laws.

Except as expressly permitted by Talehunter, you may not:

Copy or reproduce Talehunter's website content
Modify or create derivative works from Talehunter materials
Reproduce Talehunter branding or logos
Sell or redistribute Talehunter materials
Reverse engineer or attempt to extract proprietary software
Use Talehunter's trademarks or branding without permission

Your User Content remains yours as described in these Terms.

16. Third-Party Services

Talehunter may rely on third-party companies to provide certain services, including hosting, storage, payment processing, shipping, email delivery, analytics, security, and other infrastructure.

Third-party services may have their own terms and privacy policies.

Talehunter is not responsible for the independent actions, policies, availability, or security practices of third-party services outside of Talehunter's reasonable control.

17. Website Availability

We strive to keep Talehunter available and functioning properly, but we do not guarantee that the website, digital memory pages, QR codes, or other Services will always be available, uninterrupted, or error-free.

The Services may occasionally be unavailable because of:

Maintenance
Updates
Technical problems
Security incidents
Internet or hosting problems
Third-party service interruptions
Events beyond our reasonable control

Talehunter may modify or temporarily suspend portions of the Services when necessary.

18. Long-Term Memory Storage

Talehunter is designed to help preserve memories for the long term.

However, unless Talehunter expressly provides a separate written guarantee, we do not guarantee that digital content, memory pages, QR codes, or Services will remain available for any specific number of years.

Talehunter may change its technology, infrastructure, pricing, storage arrangements, or Services over time.

We will make reasonable efforts to provide notice of material changes that significantly affect active customers where appropriate.

Customers should maintain their own backup copies of important photos, videos, audio recordings, and other digital memories.

Talehunter should not be considered the sole backup or permanent archival location for irreplaceable content.

19. Account and Memory Termination

You may request that your account or memory page be deleted, subject to applicable law and our Privacy Policy.

Talehunter may suspend or terminate an account or memory page if:

You violate these Terms
Your account is involved in fraudulent or unlawful activity
Your use creates a security or legal risk
Required by law
Continued operation is no longer commercially or technically feasible

Termination may result in the loss of access to associated digital content.

Where appropriate, Talehunter may provide notice before terminating an active account or service.

20. Disclaimer of Warranties

To the maximum extent permitted by law, Talehunter provides the Services on an "as is" and "as available" basis.

We do not guarantee that:

The Services will always be available
The Services will be uninterrupted or error-free
Digital content will never be lost or corrupted
QR codes will always remain scannable
The website will be free of viruses or other harmful components
The Services will meet every individual expectation or requirement

Some jurisdictions do not allow certain warranty disclaimers, so some of these limitations may not apply to you.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Talehunter and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Services.

This may include damages resulting from:

Loss of data
Loss of digital memories
Loss of profits
Business interruption
Loss of access to a memory page
QR-code failure
Website downtime
Unauthorized access resulting from circumstances outside our reasonable control
Third-party services

To the maximum extent permitted by law, Talehunter's total liability arising from a claim relating to the Services will not exceed the amount you paid to Talehunter for the specific product or service giving rise to the claim during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.

22. Indemnification

You agree to defend, indemnify, and hold harmless Talehunter and its owners, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, and expenses arising from:

Your violation of these Terms
Your User Content
Your violation of another person's rights
Your unlawful use of the Services
Your violation of applicable laws
Your misuse of your Talehunter account or QR code

This obligation applies to the extent permitted by applicable law.

23. Copyright Complaints

If you believe that content available through Talehunter infringes your copyright, you may contact us with information sufficient for us to investigate the claim.

Your notice should generally include:

Identification of the copyrighted work
Identification of the allegedly infringing material
Your contact information
A statement that you believe the use is unauthorized
A statement that the information in your notice is accurate

Talehunter may remove or restrict access to content while investigating a legitimate copyright complaint.

24. Privacy

Your use of Talehunter is also governed by our Privacy Policy.

By using Talehunter, you acknowledge that you have reviewed our Privacy Policy.

Before initiating a formal legal proceeding, you agree to first contact Talehunter and provide a reasonable opportunity to resolve the dispute informally.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief when necessary to protect intellectual property, confidential information, security, or other rights.

Any mandatory arbitration or class-action waiver should only be included after appropriate legal review and should be drafted specifically for the laws applicable to Talehunter.

28. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

29. Entire Agreement

These Terms, together with the Talehunter Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement between you and Talehunter concerning your use of the Services.

If there is a conflict between these Terms and a separate written agreement between you and Talehunter, the separate written agreement will control to the extent of the conflict.
